1. Summary

These Terms & Conditions govern the provision of professional creative, marketing, digital and communications services by Hotel Jean. By engaging Hotel Jean, the Client agrees to be bound by these Terms.

2. What You’re Agreeing To

When you work with Hotel Jean:

  • You agree to our processes, timelines, and ways of working.

  • You are responsible for providing all materials, approvals, and access on time.

  • We do not guarantee business results, sales, rankings, or performance outcomes.

  • Payment is required upfront and non-refundable.

  • Our creative work, strategy, and documentation remain Hotel Jean’s intellectual property unless agreed in writing.

  • You are responsible for third-party platforms (like Squarespace, Google, Meta), hosting, domains, and ongoing maintenance.

  • Once you approve work or ask us to publish it, it’s considered final.

  • If a project pauses due to delays on your side, it may require reactivation fees, timeline changes, or “as-is” delivery.

3. Your Responsibilities

  • Supply all collateral, access credentials, and approvals on time.

  • Ensure any email lists, data, or marketing permissions comply with laws (Spam Act 2003, Privacy Act 1988, GDPR).

  • Take responsibility for AI-assisted content, third-party platforms, or any other tools.

  • Review work carefully. Once you approve, it’s final.

4. What We Provide

  • Creative, strategic, advisory, and process-based services - not guaranteed results.

  • Services may include: brand strategy, copywriting, design, social media, email marketing, website design/refresh, templates, campaigns, paid advertising, photography/videography, in-person production, and AI-assisted content.

  • We deliver work using our expertise and professional care, but outcomes depend on external factors (algorithms, platforms, market conditions, client actions).

5. Project Pauses or Delays

If the project is inactive for 21+ days due to client delay:

  • We may pause, suspend, or close the project.

  • Work may be delivered as-is and final.

  • A reactivation fee, updated timelines, or rates may apply if the project resumes.

6. Intellectual Property & Use

  • You get a license to use final deliverables for your intended business purpose.

  • Hotel Jean retains ownership of all underlying processes, templates, drafts, and non-final work.

  • Third-party materials (fonts, stock, templates, designer contributions) remain subject to their licenses.

  • AI outputs may not be original or legally protected — you are responsible for verification.

  • Portfolio use: We may show your project in our portfolio, marketing, awards, or promotions.

7. Payments & Refunds

  • Payment is upfront and non-refundable.

  • Advertising spend, platform fees, and third-party costs are payable regardless of outcome.

  • Hourly work is billed in 30-minute increments.

  • Unauthorised chargebacks are a breach of the agreement.

8. Approval & Refinements

  • You must follow our refinement process and deadlines.

  • Refinements are limited to allocated allowances; unused time is forfeited.

  • Once you approve or instruct us to publish, work is considered final.

9. Limitations & Liability

  • Hotel Jean does not guarantee results, rankings, revenue, or performance.

  • We are not responsible for third-party platform issues, AI inaccuracies, or external factors.

  • Liability is limited to fees paid for the services.

  • Non-excludable rights under Australian Consumer Law are limited to re-supply or cost of re-supply.

10. Termination

  • We may terminate immediately for non-payment, breach, unlawful instructions, lack of instructions, or delays over 21 days.

  • Termination for convenience is allowed; fees for services performed remain payable.

  • Projects closed due to termination are delivered as-is with no refund.
