  • How personal information is processed when you use Hotel Jean services or interact with our integrated third-party platform.

  • Client: Users who engage our Services, purchase products, or subscribe to our offerings

  • End User: Refers to anyone who interacts with our Clients’ content, bookings, or services facilitated through platforms created, edited or accessed by Hotel Jean.

We also differentiate between personal information we directly control and that handled by third-party providers:

  • Hotel Jean Controlled Information: is information for which Hotel Jean acts as the controller, determining the purposes and means of processing. This includes information collected directly from you when you access our Websites or engage our Services.

  • Third-Party Controlled Information: is information collected, accessed or processed by third-party service providers (e.g., Squarespace, Shopify, Stripe, Canva, Google, Instagram, Facebook, LinkedIn, Acuity Scheduling) acting as independent controllers or processors. Your use of their services is also subject to their privacy policies.

2. Definitions & Interpretation

1.1. “Hotel Jean,” “we,” “us,” or “our” means Hotel Jean (our successors and assigns) or any person acting with authority from Hotel Jean.

1.2. “Client,” “you,” or “your” means the Client purchasing Services from us or any person acting on your behalf.

1.3. “Services” includes all incidental items, advice, designs, website development, branding, marketing, photography, copywriting, social media support, project management, and any other services provided by Hotel Jean. This includes but is not limited to any printed or virtual material, content calendars, social media support, website design, copywriting, samples, designs, drawings, images, graphics, advertising,  search engine optimisation, publication, data, files, information or other associated documentation and goods, software, or any advice or recommendations, personal development, Website development, graphic design, consultancy, marketing assessment, brand  development, integration of strategies, analysis, project management, videography, photography, or media sourcing,  provided by us at your request from time to time (and where the context permits, the terms Incidental Items or Services shall be interchangeable for the other). 

1.4. “Agreement” means our terms & conditions of trade, including this Privacy Policy, any SLA, orders, purchases, or schedules.

1.5. “Cookies” means small files stored on a user’s computer or device, holding data specific to a particular Client or Website.

1.6. “Personal Information” has the meaning given under the Privacy Act 2020 (NZ), the GDPR, or other applicable data protection legislation.

1.7. “Website” means a location accessible on the internet providing multimedia content via a graphical user interface.

1.8. Headings are for convenience only. References to legislation include all related regulations, instruments, guidelines, or amendments.

3. Personal Information We Collect

3.1. We collect Personal Information necessary to provide our Services, including but not limited to:

  • Name, email, phone, and contact details

  • Billing/shipping address

  • Payment information

  • Purchase or subscription history

  • Interaction with our Services (analytics, preferences, cookies)

  • Files you upload

We collect personal information both when you interact with our Website and when you engage our Services directly.

3.2. This website collects personal data to power our site analytics, including:

  • Information about your browser, network, and device

  • Web pages you visited prior to coming to this website

  • Your IP address

  • This information may also include details about your use of this website, including:

We share this information with Squarespace, our website analytics provider, to learn about site traffic and activity.

3.3. We gather information about our Website user's Personal Information provided when you complete an online form or request our Services. When visitors leave comments on the Website, we may collect the data shown in the comments form and the visitor’s IP address and  browser user agent string to help spam detection. Google Analytics or our web servers collected information can include the following types: 

(a)the date and time of visits to the Website 

(b)pages viewed; 

(c)the referring Website; 

(d)your IP address; and 

(e)technical information on browser connections.

We may collect unique identifiers, browser type and settings, device type, operating system, and mobile network information (including the carrier name, phone number, and application data). We may also collect information about the interaction of your apps, browsers, and devices with our  Services, including IP address, crash reports, system activity, and the  date, time, and referrer URL of your request.

5. How We Use Information

5.1. We use collected information to:

5.2 Use of Client Content for Marketing and Portfolio Purposes

Hotel Jean may use non-confidential content you provide, including results, numbers, images, website designs, and other materials, for marketing, advertising, portfolio, or promotional purposes. Any personal information contained within these materials will be handled strictly in accordance with this Privacy Policy and applicable privacy laws (e.g., Privacy Act 2020 (NZ), Australian Privacy Act 1988, GDPR).

You have the right to request restrictions on the use of your personal information for marketing purposes where applicable. We will comply with such requests unless legally required to retain or process the information.

5.3. When Hotel Jean processes personal information on behalf of a client in the course of providing services, we act as a data processor (under the GDPR) and a service provider or data processor for the purposes of the Australian Privacy Act 1988 (Cth), as applicable.

Our processing of personal information on behalf of clients is governed by our Data Processing Addendum (DPA), which is incorporated by reference into this Privacy Policy and forms part of our contractual arrangements with clients.

The DPA sets out, among other things:

  • The scope, nature and purpose of data processing

  • The categories of personal data and data subjects involved

  • A list of approved Sub-Processors used to deliver our services

  • Hotel Jean’s obligations regarding confidentiality, security measures, and data breach response

  • The engagement of sub-processors

  • Assistance with data subject rights under applicable data protection laws, including the GDPR and Australian Privacy Principles

  • Instructions for Data Subject Rights requests (access, correction, deletion, objection)

6. Disclosure of Information

6.1. We may disclose Personal Information to:

  • Third-party service providers (listed in Section 4.3)

  • Legal or regulatory authorities where required

  • Business successors in case of acquisition or transfer

6.2. We may also share aggregated, de-identified data publicly or with contractors for analytics and marketing purposes.

6.3. We will share Personal Information outside of our business if we have a  good-faith belief that access, use, preservation, or disclosure of the data  is reasonably necessary to: 

(a)meet any applicable law, regulation, legal process, or enforceable  governmental request; 

(b)enforce applicable terms of our service, including investigation of  potential violations; 

(c)detect, prevent, or otherwise address fraud, security, or technical  issues; and 

(d)protect against harm to our rights, property, safety, users, or the public  as required or permitted by law. 

6.4. If a third party acquires us or substantially all of our assets, our Client  information will be one of the transferred assets. We will continue to ensure the confidentiality of any Personal Information and will give  affected users notice before personal data is transferred or becomes  subject to a different privacy policy.

6.5. We may also send automated emails for abandoned carts, order updates, or account activity. Marketing emails may be sent via Squarespace; you can unsubscribe via links provided in the emails.

6.6. Payment information is shared with Stripe and Squarespace Payments. Their privacy policies are available at Stripe.

6.7. We do not sell your Personal Information.

7.1. We use Cookies (including Cookies developed by our third-party service providers such as Google Analytics) for several purposes, including  improving our Services and enhancing your online experience with us  and maintaining the secure connection between your browser and our  servers while using our Website.

We may store and process information (both personal and non-personally identifiable information) on servers in several different countries worldwide. Information held in another country will be subject to that country's privacy laws.

8.3. We retain Personal Information only as long as necessary to fulfil purposes outlined in this Policy, comply with legal obligations, or enforce our agreements.

14. Squarespace & Third-Party Providers

Hotel Jean websites are hosted on Squarespace. Data collected via the Website is subject to both this Policy and Squarespace’s Privacy Policy.

Hotel Jean works with third-party service providers to operate our business and deliver Services. These third parties may act as data processors or independent controllers and process personal information in accordance with their privacy policies and applicable laws. We share information reasonably necessary for them to perform services.

Where relevant, these providers may include but are not limited to:

  • Website hosting and eCommerce platforms: Squarespace, Shopify

  • Payment processing: Squarespace Payments, Stripe

  • Design & creative tools: Canva, Adobe suite

  • Social media & advertising: Instagram, Facebook (Meta), LinkedIn

  • Analytics & performance tools: Google Analytics, Google Search Console

  • Scheduling & calendar tools: Google Calendar, Acuity Scheduling

We share personal information reasonably necessary for these providers to perform their services and take steps to ensure they maintain appropriate security, confidentiality, and data protection safeguards.

When you interact directly with any third-party platform (e.g., making a payment or booking), your personal information is governed by that provider’s privacy policy.
